Terms of Service
These are the terms between you and Vibe Labs, Unip. Lda. when you use The Vibe app, the Business Console, or thevibe.in. By signing up or tapping a button that says “I agree”, you agree to all of this.
The short version
Be 18+. Don’t be a jerk to other members or businesses. Tickets are tickets, so read the refund policy. We can suspend accounts that abuse the service. Disputes go to arbitration in your country of residence, with EU consumer rights preserved.
1. Accepting these terms
By creating an account, accessing, or using The Vibe, you confirm you are at least 18 years old and have the legal capacity to enter into a contract. If you’re using The Vibe on behalf of a venue or organization, you represent that you’re authorized to bind that organization to these terms.
2. Your account
You are responsible for keeping your login credentials secure and for everything that happens under your account. Notify us at support@thevibe.in immediately if you suspect unauthorized access. One person, one account; duplicate accounts may be suspended.
3. Conduct & community
You agree not to:
- Harass, threaten, or impersonate any person or venue;
- Reverse-engineer, scrape, or interfere with the service;
- Resell tickets above face value or operate as an unauthorized broker;
- Use the service for any unlawful, fraudulent, or hateful purpose;
- Upload content you do not own or have permission to share.
4. RSVPs & tickets
The Vibe sells tickets and accepts RSVPs as an authorized agent of the venue. The contract for the event itself is between you and the venue. Each ticket includes a unique QR code; transferring it outside our official transfer flow voids it.
5. Refunds
If a venue cancels or materially changes an event, you’ll receive an automatic full refund within 5 business days. If you can’t attend, you can transfer your ticket to another Vibe member up to 2 hours before doors. Member-initiated refunds otherwise depend on the venue’s policy, displayed before checkout.
6. Fees & billing
The Vibe app is free for members. Service fees on paid tickets, where applicable, are shown before checkout. Vibe Plus, our optional subscription, is billed monthly or annually and can be cancelled at any time from Settings → Subscription. Business plans are billed under a separate Master Services Agreement.
7. Your content
You keep ownership of everything you post: reviews, photos, profile content. You grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, and adapt that content solely to operate and promote the service (including in marketing assets). You can revoke this license by deleting the content; we’ll remove it within 30 days.
8. Our intellectual property
The Vibe name, logo, app, and all underlying software are owned by Vibe Labs and protected by copyright and trademark law. We grant you a personal, revocable, non-transferable license to use the service in accordance with these terms.
9. Third-party services
The service uses third-party providers (payments, maps, push notifications, social login). Their terms apply to their portions of the service. We’re not responsible for their availability or content.
10. Termination
You can close your account at any time from Settings → Privacy → Delete account. We may suspend or terminate accounts that materially breach these terms, with notice where reasonable, except in cases of safety risk or fraud.
11. Disclaimers
The service is provided “as is” and “as available”. We make no warranty that events will meet your expectations, that the app will be uninterrupted, or that recommendations will be perfect. Some jurisdictions don’t allow these disclaimers; in those, our liability is limited to the maximum extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of these terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100. We are not liable for indirect, incidental, special, or consequential damages. Nothing in this clause limits liability that cannot be limited by law (e.g. EU consumer rights, gross negligence, willful misconduct).
13. Disputes
If you have a problem, please email support@thevibe.infirst. If we can’t resolve it within 60 days, EU consumers may use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Otherwise, disputes are resolved by binding arbitration in your country of residence, under the rules of the local arbitration association. You retain your right to bring small-claims actions in your local court.
14. General
These terms are governed by the laws of Portugal, without regard to conflict-of-law principles, and subject to mandatory consumer-protection laws of your country of residence. If any provision is held unenforceable, the rest remain in effect. We may update these terms; we’ll notify you at least 30 days in advance for material changes. The English version controls in case of translation conflicts.
